1. Agreement
These Terms of Service ("Terms") govern your access to and use of the websites, products, and services (collectively, the "Services") provided by The Pulse Boost ("The Pulse Boost," "we," "us," or "our"). By purchasing, accessing, or using the Services, you agree to be bound by these Terms.
2. Services
The Pulse Boost provides website design, development, hosting, and related growth power-ups (booking, payments, email confirmations, and bundles thereof). Specific deliverables, timelines, and inclusions are described on your order and on our marketing pages at the time of purchase.
3. Fees, Billing & Subscriptions
- One-time setup fees are charged at checkout and are non-refundable once work begins.
- Monthly subscription fees begin on launch and recur each month until cancelled.
- All amounts are in USD and exclusive of applicable taxes, which are calculated at checkout.
- You authorize us (via Stripe) to charge your payment method for all fees you incur.
4. Cancellation
You may cancel your monthly subscription at any time from your customer portal. Cancellations take effect at the end of the current billing cycle. We do not provide pro-rated refunds for partial months. If you cancel, your hosted site and connected power-ups will be deactivated.
5. Client Responsibilities
- Provide accurate business information, content, and timely feedback.
- Hold the rights to all materials you supply (logos, photos, copy, etc.).
- Maintain access to any third-party accounts (domain, email, social, payment) we need.
6. Intellectual Property
Upon full payment of the setup fee, you own the custom design and content created specifically for your site. We retain ownership of our underlying frameworks, templates, code libraries, and tooling. We may display your project in our portfolio unless you request otherwise in writing.
7. Acceptable Use
You may not use the Services for unlawful, infringing, deceptive, or harmful purposes, including but not limited to spam, malware distribution, hate content, or activities that violate third-party rights. We may suspend Services that violate these Terms.
8. Third-Party Services
The Services rely on third-party providers (e.g., Stripe for payments, hosting providers, email delivery, scheduling tools). Your use of those features is also subject to those providers' terms.
9. Warranty Disclaimer
The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific business results, traffic, or revenue.
10. Limitation of Liability
To the maximum extent permitted by law, The Pulse Boost will not be liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenue, or data. Our total liability for any claim arising out of or related to the Services will not exceed the amount you paid us in the three (3) months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless The Pulse Boost from any claims, damages, or expenses arising out of your content, your use of the Services, or your violation of these Terms.
12. Changes to the Terms
We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Continued use of the Services after changes constitutes acceptance.
13. Governing Law
These Terms are governed by the laws of the State of Georgia, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Georgia.
